I want to apply for bankruptcy, but I only have £100 amonth to save up for the costs to apply for bankruptcy, which means I do not have any money spare to pay my crditors while I am saving up. What can I say to my creditors to try to stop them taking me to court while I am saving up?

Hello,

I was told by wefare rights that some utility companies might pay your BR fees. Contact your local welfare rights service they are part of the council. I found them really helpful. You have to have a good reason for going BR and have not run the debts up un-responsibility.

Thank you for your help, I am only paying my crediotrs £1.00 a month at the moment as this is all I have, and the CCCS and Pay plan advised me to do this. I will not be able to save up the £100.00 a month to go bankrupt until September when my daughter goes to school as I will not be paying such high nursey fees and will be able to save the money then. I am really worried that the creditors are going to take me to court while I am saving up the money and try to obtain a detachment od earnings order on me, as this would put me in more fianacial difficulty. Some of mr creditors have accepted the £1.00 a month token payment for 6 months but I still have 6 creditors that are saying they wont accept it, I still end it to them anyway. Have you got any advice for me?

The best thing to do is book your bankruptcy hearing date (either by contacting the court for the next available date - or if they are operating a 'drop in' service, decide on what date you are going to go to the court for your hearing, and then inform any creditors who contact you that you have a bankruptcy hearing on..... at...County Court. We went bankrupt on friday 17th july but stopped paying our creditor in January, we got the first letter about being taken to court today, 7 months later!

It takes several months for your creditors to take court action. initially this is just prove legaly that you owe the debt

Hello,
I am in the same position. What I have decided to do is cancel my direct debits for 2 loans and not pay my credit cards or any other debt and use that money. I am not an underhanded / devious person but its the only way. Hope this helps
