I have recently been discharged from Bankruptcy – i am in the process of buying back my property from the Insolvency Agency due to negative equity – i am the sole owner the purchase price is £1 which has already been paid to the insolvency service and also have paid on account their legal costs - i have been told that i need the services of a solicitor myself. please advise what my solicitor would need to do and expected costs involved

Hi Bad Manners 2002, I think another poster on the forum has been/going through the same thing requested by OR Solicitors, the poster is Christine123 if you have a look at her posts it might help you a little. Sorry I couldn't help you any further.

the following is taken from a letter from the solictors representing the insolvency service - does this mean i need to arrange this myself or is this done by their solicitors....

As the property is solely owned, both the legal and beneficial interest vest with the Official Receiver. You will therefore require the services of a solicitor to obtain the consent of the mortgagee, deal with the completion and submission of the Stamp Duty Land Tax Return and register the Transfer at the Land Registry. Until registration of the Transfer the property will remain vested with the Official Receiver and the legal formalities not concluded.

You are only give the option to have one if you really want one - there is no actual need. Many people here on the forum will confirm that they have not ussed a solicitor for this purpose, it is a very straightforward process by the OR - Why incur unnecessary fees?
