Hi all. Im here for a freind to try and help her she does not have internet access.

This is her position and we would like some outside advice.
Forced to resign 5 weeks ago.

Claiming JSA but has been told this mayby withdrawn.

Homeless. Been advised to claim housing benifit.
no other income, no assets, about £1000 to name which will be used to secure housing.

Outgoings
Pets 16 yr old cat, 8 year old dog on perminant medication. Insurances cancelled due to affordability. cost £45pcm
Shopping £100pcm (food and personal hygiene)
Car for universerty and voluntary work currently liveing accomdation.
cost £120pcm
Car is not owned by her nore leased or hired just loaned. She just maintaine's taxes insurance, mot's, servicing, fuel ect.
Phone contract £30 pcm
This is basic outgoings of £295
total income £278. Thats a short full of £17pcm
Now remenber JSA is not garrenteed.
housing when claimed should cover housing costs.
Meaning no change in finances barring no saveings.
She has applied for lots of jobs had lost of interviews but failed to secure work. It's looking very bleak at present.
She has a loan about £7000 at £190pcm. This month she took her only payment holiday for 1 month. Now their is no income to pay it.
We are looking at bankruptcy or the newish scheme thats about.
She is a part time uni student about to start her 3rd year of degree I have offered to pay her fees if cannot get them paid any other way.
She has to do 10hrs in sutible workplace so has got two days volentary work to enable this.
We would appricaite any advice please.
We have looked at advising the bank that loan is with that she cannot pay but do not want the CCJ route as this lasts for years.
If we could loose the phone contract and loan. Then she would be able to concerntract on studying and getting a new job. Neither have any real understanding of the system.

There are a few jobs that you can't do as an un-discharged bankrupt:

- Armed Forces
- Police (I think)
- You can't be a director of your own company
- Some finance jobs
- Any job that requires a credit check could also be a problem for obvious reasons

Once you are discharged (12 months after declaring BR) then you can be a director of your own company and joining the Armed Forces should be ok.

I am not too sure about the Finance sector jobs and those that carry out a credit check. If this is the type of job she would be looking for then it is always better to be open and mention that she was BR at the interview.

we have worked out £120 for car £35 for phone £145 for liveing (£290 for rent via HB) When secure one not easy with dog in tow. we worked out that when she gets a job its prob going to be 4 days a week due to uni and min wage. So with haveing to pay rent herself and increased outgoing due to working she still will not have any disposable income. So this is looking a very good system.

but still is their any jobs it would affect you applying for as this is the main concern?

Ps can councils demand to know where you are every night of the week whilst on the houseing list if you are homeless ? As they have withdrawn her from the housing list, till proof of where and when she is staying is supplied. But occommadiation is so randon last week she spent four nights in atent in her aunts back garden.

We sort advice on this already but her work place followed procedure and although she had no previous disaplines she failed to say two words. This was classed as gross neglagence and told hand in your notice now and walk, we will supply a good reference or be sacked and no reference will be given. Put on the spot like this she resigned. I was gutted that she told her manager she had forgotten to say these two words. Had she, not been honest but a dishonest person, she would still have a job today.
It also appears that her manager was given the same altermaton for ducking out of work and leaving my freind in charge even though there was higher level staff on site.

Just want to get as much info as posable.
Saying £295 for rent and food would be lieing and that appears to have great reprocusions if found out.

Total outgoings of £295 including rent and food will NOT be a problem with any OR anywhere - your Friend needs to book an appointment with CAB tomorrow morning.

One thin that lept out in your initial post was "Forced to Resign" - make sure CAB are made aware of that as Constructive Dismissal still remains illegal in this country!!!

Again - get your Friend down to CAB ASAP!

In short £90 require see CAB to arrange it.
then if disposable income does not exceed £50 pcm in 12months life returns to normal.

Is their any long term side effects such as not being able to apply for certain jobs ?

Is their some where We can find out what is acceptable outgoings ?

With a debt of £7k and no assets then a Debt Relief Order (DRO) could well be the best option. There is some advice on exactly what a DRO is, how it works, how to apply for it, etc. at http://www.insolvency.gov.uk/pdfs/guidanceleafletspdf/droguide.pdf

The agencies that are listed on the form can also provide guidance as to whether a DRO is going to be the best option or if there is another way out of this situation.
