Posted - 29 August 2009 : 21:47:32 hi, please can i have some help im in a awful mess, i was in an iva last for about 6 months when i lost my job, i had a three month break to find a new job but didnt, i tried so hard as well. My iva was failed even though i tried to get them to accept a lower payment, i wrote to all my creditors to offer them a small sum rather than nothing but got no response, now i am filling out bankruptcy papers as even though i have a job now it is only a temp and much lower pay than before and my iva has failed, am i doing the right thing? i have no assets like a house or car and could have done it ages ago but wanted so much to pay my debts but i really cant now. please can i have some advice, am i doing the right thing im only 26 and in such a mess. thnak you |

I too am 26 I have had two failed IVAs, three failed DMPS and creditors ignored informal arrangements. In all honesty bankkruptcy was the best option for me, and sounds, due to your unstable income at the moment to be the best option for you too. There are others available depeending on your level of debts and any disposable income available.
I would concentrate on
1. Saving the amount needed for bankruptcy 2. Joining a bankruptcy friendly bank account such as coop, barclays cashcard, thinkbanking, clearcash, credecard services or spectrum services 3. Getting your appointment for bankruptcy at the court 4. Discussing with the CAB regarding debt solutions to finalise that it is your best option 5. Goto insolvency service website to do forms

I am also 26 and I am currently saving for my bankruptcy fees and filling my forms in bit by bit. I completely understand how you feel.
I was left in a really crappy situation a few years ago, had my flat repossessed now I owe mortgage company £59k!!
I think as long as you can say that you tried as hard as you could then you should try not to let it worry you and get you down. I know its easier said than done!!
The way I try and look at is I would rather do this now than struggle for the next couple of years and have to do it then.
Only you can decide if it is the best option for you also, you may have already done so, but you have to seek legal advice.
Please try not to worry. It can only get better from here.
I know I havent exactly given you advice just want you to know you are not the only 26 year old to do this and we certainly wont be the last.
