 hi there im booked in for a bankruptcy hearing

hi there im booked in for a bankruptcy hearing on the 19th of november. im sorry to repeat a question which you probably get every day, but what should i expect to happen on the day? many thanks, Dean

Hi

Courts do vary, but generally speaking:

Arrive ahead of the time so that you are not rushing!

Take two copies of the SOA

You will have to swear or affirm that the SOA is true and correct to one of the court staff

You will have to pay your fee - £510 if it is a sole BR

The court clerk will say if you have to see the DJ - he/she will take the papers to the DJ in advance

The DJ will either stamp the SOA and declare you BR - you will get a copy of the judgement or you may have to go before the DJ briefly - it should only take 2 or 3 minutes before the DJ.

You are then officially an undischarged BR - the OR will be informed and contact made for you to have a telephone interview or to go to the OR`s office for an interview with an examiner. (I had an appointment made for me to go to the OR that day - but that was 6 months ago and courts are busier now and they vary from court to court)

Hi there

Take you forms (2 copies) with you , do not sign or date until in the presence of the court clerk, also have with your the required fee. Depending on the court used, many will now take the copies of the forms from you and either ask you to wait, or tell you to come back after lunch. Some courts (quiet ones!) still take you to see the districtjudge, but don't be alarmed this is just a person in a room, not 'open court' The district judge will confirm your name etc and ask whether you have taken advice (this site acts as advice). Either way you will receive a copy of the Order back and be informed that the Official Receiver will be in touch to book a telephone appointment with you. I usually recommend to clients i take through the process to take an additional copy of the forms, so that when you have your telephone chat with the OR you can go through the forms with them looking at your own copy at the same time, and making any notes etc The OR telephone interview may be up to 2 weeks after the Court hearing
