Posted - 17 November 2009 : 22:26:40 Could do with some advice! My Husband and I went bankrupt last Tuesday and have our OR interview next Tuesday. We have a loan secured on our mortgage with first plus, and have paid out an insurance premium every month as part of the loan in case we lost our jobs etc. If we did not claim on the insurance within the 5 years we were entitiled to a refund of the premium we have paid for the payment protection insurance. We have just received a cheque in the post today for £16745.19. I know that the OR will want the money and I know we owe it for debts, but I was wondering the following... We could really do with money for a new washing machine, a new sofa. I have recently been diagnosed with arthritis and the old one is wrecked (I need more support) a bed for our little boy who is moving out of his cot, a new mattress for myself, a new fire as our old electric is playing up (blowing out cold air) and new tyres for our car. I know it is a really long list and we were going to make do without but do you think the OR would allow us any money for any of these? Also do I cash the cheque or keep it till I have spoken to the OR? Should I ring them straightaway or wait till the interview on Tuesday? Thanks in advance xxx |

what really bad timming prior to BR we would all be made upto receive a cheque like that through the post
As Chester has said it is not your money the OR has total control over your possessions and accounts. you are potentially spending his money. Repeating one of chesters phrases BR is all about getting your ducks in order before the day.
you will have to justify any real needs, the Or will / could ask quite searching questions to establish a real need for the items and they are not just luxury
Arthritis, doctor certificate recomending that it will be detremental to your treatemnt and welfare if you do not get a sofa with proper body support, take photgraphs of your old sofa bring costings of a new sofa. does the old washing machine work .. why exactly does it need replacing is the electric heater the only heating source in the house ..why do you need better heating. you may be able to provide a better argument about your sons bed than your own. do you actually need the car
Im not asking these question i am suggesting some of the comments that the OR might have to put to you.
to have any chance of the OR being really nice you will have to show absolute need not just it would be nice to have

Posted - 18 November 2009 : 12:24:15 I disagree slightly, I think you may be allowed some of it for those essential items
If I were you, I would make a list of things you really need and when you inform the OR of this money, you can plead your case for these items, depending on the OR, you may get to keep some of it |

Posted - 17 November 2009 : 23:25:00 officially it is not your money to cash or spend. any asset that comes to you before discharge is the OR's. i feel it would be unlikely that the OR would let you keep any of the money. i would not cash the cheque and tell the OR when you speak with him , he will advise you what to do with it.
