Help!!!
Myself and my husband went bankrupt back in September this year. We stopped paying our mortgage so we could save to rent a property. We have been to our local council housing department who are about as useful as a chocolate teapot (thats putting it mildly!). They gave us one option of a mortgage rescue scheme where the housing association buy a share of our property anything up to 75% and the balance would still be with our mortgage lender. We declined their offer as when rates go up we will end up paying more for our house than we are earning. They told us if we get made homeless they wouldnt help as we havent taken up their only offer of help. We have been looking around different letting agents and have explained our situation, no one it seems are willing to give us a go. My husband works full time so the rent money wouldnt be a problem. Other wise they want 6 months in advance and we just dont have it. We have a court date from our mortgage company for possession which is 9 December. I have 4 children and with christmas coming things are getting worse. I dont know what else to do.
Any suggestions

Hi Deb

My BR is due to finish in Feb and I still need to find a rental property if my negative equity is to be covered by my BR.
The clock is ticking and if I don't find somewhere suitable the negative equity will be back in my court.I will then have to hope House prices rise over the next few years.

Thanks everyone.
We voluntarily surrendered the house. We just needed to get out for the sake of the family and just start again. The hearing is on Wednesday for possession but we are not attending, as we know what the outcome will be.

Glad you have found somewhere to rent. At least you will not have to worry over Christmas.

Did you voluntarily surrender your house or did you leave it to the Building society to reposess.

Just an update. We have found a house to private rent and are moving in just over 1 week. Just in time for Christmas. We are not going to court on the 9th Dec and we have given up our property. Its the best decision we made. Thanks for all your help and advice.

Once the house is repossessed you will be homelsss & the council will have to house you so don't worry, with 4 children you won't end up on the streets.

Hi

I will try to assist, first, can you answer the following:

I assume the mortgage lender is taking action for the first time?

If possible, would you like to stay in the house? (You say your partner has a good income)

Have you spoken/written to them (your lender)to explain your position?

If this is the first action, the DJ will give an SPO - I can tell you what you need to do with a bit more information from you

When you went to see the homeless persons section of your housing department what precisely did they offer you?

I would suggest that you make a further appointment to see a more senior officer!!

Do you intent to go to the County court on the 9th December? - (I would - if you want a chance to stay in the property)

Not knowing what other debts you have it is difficult to give good advice - what else do you have that is owed to creditors?

Do you have any equity?

Happy to assist in more depth if you can give a bit more detail and do not stress - you can maybe get out of this - depends on the bigger picture
