Posted - 12 April 2009 : 20:27:24 i have been split with my x for 5 years.we have a joint morgage i live in the house with our child age 14 in the paper this week was the notice he has gone bankrupt. didnt know nothing about this at all,and when i got in touch with him he would not tell me nothing. Do i need to get a solicitor to fight my corner? i can only afford to add a small amount on my morgage if im forced to remorgage. very worried please help, TJ

Posted - 12 April 2009 : 21:21:11 he has paid the morgage in the fives years part of the settlement,and continues to pay,so lots of intrest in the property. looks like im going to be the loser in this game [we was never married]

at this stage I would not suggest you rush out and engage professional help which will cost. Where insolvency is concerned often the law is quite straightforward so the need for help will be determined by the complexities of the situation.
What is the estimated level of equity in the property? When did your ex husband last contribute any monies toward the mortgage? What was the estimated level of equity in the property at that time and do you have any evidence at hand to support your estimate?
Just 3 of many questions that would need to be answered in order to determine your ex husbands level of interest, if any, in the property.
Also was the date of his bankruptcy before or after the 5th anniversary of the last time he made a contribution?
