I've just been discharged in Jan 2010, with no restrictions - Felt fantastic! To cut a long story short, when i was made bankrupt i owned my own beauty salon and ended up closing owing money to some clients who had bought gift vouchers. I put notices on the doors and there was the usual ad for creditors to contact the OR etc. My sister was an employee at my beauty salon and purchased some of my equipt off the OR and leasing company and set up her own business in Sept of this year in a different town.
Today my sister had someone calling her up - acusing her of co-owning my old business and telling her they had vouchers and if she wasnt prepared to do anything with them they would write to the local paper. My sister tried to explain the situation but the lady shouted at her and slammed the phone down in the end!!
Any advice what she or I could tell this lady?

officiallly as long as your sister was not a partner in the business all of the debts associated are now the responsibility of the official receiver and if this lady has an issue she should deal with the OR.
however in practical and real life this lady can make it very difficult for your sister, it may be that she has had the phone call and said what she wants to and that is the end of the scenario.
if she phones again she may be calmed with a % discount (doubt it) promotional discount to all new customers !
If she goes to the local press, you will have to work at turning this into a positive story, the press will be very careful about printing an inaccuracy so will want your sisters version of events.
not what either of you really want but good luck

The debts to all your clients to whom you have sold vouchers will be written off and legally there is nothing that this lady can do. She has obviously resorted to harrassing your sister to try and get something back. Neither your sister nor you have done anything wrong and I would say let her go to the papers! As Richard so rightly points out, the paper will not publish somethimg that is inaccurate nor in the public interest. This woman is unlikely to know the bankruptcy laws and I suspect that she is trying to frighten you and will not go to the papers. If she does, please let us know as I dare say that what is written will be wrong and therefore you can sue.

The replies from Richard P and John are right.
A couiple of my creditors started to hassle me post BR and I said to them, I am BR - all your dealings must be channelled through the OR - I heard nothing else!!
Good luck and if they do go to the press, if what is said is defamatory, then sue them - do not take any CR**

| Tbh, a lot of business is founded on good will & if your sister is tainted with your failed business it won't help her, If it were me, I think I would explain the BR & maybe offer a free cut or whatever as "goodwill". How much did you owe in vouchers out of interest? |

I think the max this lady has is probably about £20 which would have been bought about 15 months ago. As the salon has been closed now for over a year. When my salon closed, my sister did write to most of the old clients offering discounts at a temp salon where she rented a room. The problem she has now offering a free treatment would be that she'd have to offer it to everyone and she works on her own. Thanks for your advise! |

Hi again,
Just to say that today in my post, came a letter from a creditor (I am not discharged as yet), saying pay me the money you owe me...
I have had two people over the past 10 months contact me - one came to the door twice and was politely told that the matter was with the Official Receiver.
I am thinking about my response to this creditor today and think that I will ignore him - best that way.

No Go on Housing send them an unsensored letter !
i wrote across one in orange crayon and sent it back to them suprisingly they have not been in contact since
prob best to as you say ignore

I have plenty of crayons - I actually feel angry and upset and I think to do anything at the moment, would be folly.
They had better not do it again!
