My wife and I were discharged from Bankruptcy in Nov 2007, we have not heard from the trustee until a couple of days ago, asking us to fill out an income & expenditure form. I have spoken to an I.P. regarding this and they are under the impression that an Income Order cannot be made after being discharged. Is this correct?? I have spoken to the trustee and he was really nasty and rude. I have always co-operated with him and have sent all and everything he has asked for in the past. Any ideas??? Really not sure how to proceed, I guess if I sent the income and expenditure form off then he will want to take a proportion of my wage or has he left it too late?? Any advice would be appreciated. Thanks |

Hi Den
if you can shown that you have complied with their requests for information and you have been discharged from bankruptcy, that is it FULL STOP.
They can for non co-operation or deliberate lying reopen cases but these are very rare.
Might be worth emailing one of the experts and asking them to act on your behalf

Hi Den
As Richard P says, once you are discharged, as long as you have made full and true disclosure whilst bankrupt, and no IPA/IPO is in place, they can't now ask you for a contribution from your earnings.
I can't really think why your trustee would need to know now, nearly three years after discharge, what your I&E is. It may be that he is in the process of closing his file and this is just on their checklist of things to do.
If it was me I would do a letter back asking why he wants the information before providing it, that way you can't be accused of non-co-operation
Good luck
