I was made bankrupt on Nov 2008. I am now discharged.
I am still in my home as the OR have had it valued at the beginning of the bankruptcy....Negative equity.
Ive had heard nothing since.
Anyway i have two equitable charges from Natwest and Mortgage Express on my home property.
Natwest before i was made bankrupt and Mortgage express after. However the Mortage Express was a B2L property which was repossessed before i was made bankrupt and sold on with a deficit before Nov 08.
I would like know if these charges get removed as i was bankrupt? If so how?
If not, then what implications does this have on my property?
welcome to the forum the charges made before BR will stand and will have to be paid when the house is sold any charge made after BR for a debt pre BR is invalid and if you forward a copy of your BO to the land registry with a copy of the charging order they will have it removed.

no, if they got there first and got a final charging order before the bankruptcy order than the debt will always have the potentil to be paid out of any sale proceeds
