I am seriously thinking to go bankrupt - to petititon my ownbankruptcy My main fear is that the Offical receiver could ask me to make a payment towards my bankruptcy - by taking money direct from my employer
Am I allowed to say that I do not wish this to happen If theyrefused this - am I allowed not to go forward with the bankruptcy (i work for a dodgy organisation and would not like my boss to have this information in this way.
If your disposable income was high enough the OR would seek a contribution from your earnings, but it would be by way of a standing order (or direct debit - I've never worked out which) from your bank - the only reason he would apply for an attachment of earnings order (where it is paid by your employer deducting it from your wages) would be if you refused to accept an income payment agreement and the OR went to Court for an income payment order

1) after establishing your income and expenditure you had a disposable income. 2) you refused to cooperate with them and make payments by standing order or direct debit.
