Hello
Does anyone know what forms of employment will be affected for a bankrupt person. I.e. I may be able to work for a Government Dept (Police) but am a bankrupt (discharged). The 21 page security vetting finance page asks if you have ever defaulted on a loan, had a judgment entered against you, been bankrupt. The answers for me would be YES. Is this likely to end any chance of a job. Should I now just bin the application security clearance form. I cannot ask HR about it? Someone was asked this question when they were submitting their forms and when they said NO, I have never defaulted etc etc they were told yes no problem, you are very good. Does that mean that I will be seen as a very BAD person then, and application rejected when they see the financial information? I tried for a whole year to get work and could get nothing. This new position would be a temporary one through an Agency.

I don't want to waste (security vetting) their time as I know it takes six weeks to finalise. Has anyone had experience of this at all, or what the legal stand is. I had not expected the financial page to ask all these detailed questions. Many thanks.

The legal aspect is, if they dont want to employ you they dont have to, there is nothing saying they cant employ you, it is down to their preference.
Sometimes the just want to know al your secrets so that you cant be blackmailed later

I assumed there might be a set ruling for employers to follow not just do as they feel like/preference? Are there not any legal guidelines. Either for/against?

There are a very few jobs that you cannot do legaly because of a bankruptcy such as if you are an independant financial advisor but most and the job you are doing it will be down to the employers own preference

Hi Angie

The police and other govt agencies are getting better at looking after staff who experience financial difficulties.

As they are able to cherry pick the candidates that apply for jobs with them, they can and do "unofficiallly" decline to proceed with current undischarged bankrupts.

However discharged bankrupts have "served their time" and more often than not more concious with finances than other applicants who are still burdened with life style debt.

It is likely that they will carry out a quick finance search on you, if you have not declared on the application they will bin your application, so declare your past and put in a good application.

The Govt organisations still advertise that they interview for the right and best candidate for the post, why should that not be you ?

Many thanks Richard. I had intended to be honest and upfront I just did not want to waste their time if it was already a DONE DEAL that they would REJECT my application because of the past. I would rather be rejected for another reason but think it unfair if it is solely on a bankruptcy. I have learnt my lesson. I pay my bills first and eat second. That is how I live my life now.
