 Hi I am making myself bankrupt on the 27th July

Hi
I am making myself bankrupt on the 27th July, I currently live in rented property with my children but are planning on moving in with my boyfriend a week after that. He owns his property. Will my bankruptcy affect him in any way? Would they take his income into account even though he would refuse to be part of this as the debts are not in his name. Should I tell the receiver on the day of bankruptcy that my circumstances are going to change or should I move in with my boyfriend first and then make myself bankrupt. Many thanks

The OR can't force your boyfriend to declare his income or to pay anything towards an IPA (Income Payment Agreement) if you have one and he won't be affected by your BR.

It would be better to move out of your rented property once you are BR as this will be the address listed on your BR rather than your boyfriend's address.

Once you declare BR you should be contacted by the OR within about a week to schedule the OR's interview and you can mention then that you are moving in with your boyfriend.

Just to add, His credit record would only be affected if you have any joint financial products.

Even though the new address would not be on the bankruptcy order it would still be changed on the Insolvency Register.

Although they cannot force your partner to declare his income, if he does not they will just disallow 50% of the household outgoings as they will presume that he pays 50% of them

Thank you both for your response.

I have just been reading the insolvency service leaflet and I'm a bit confused to what I should include as income, it says benefits (excluding child benefits)
Does this mean child benefit and child tax credits? as it tells you to include working tax credits. And do I need to include child maintenance paid by their father?

I have also read about NT tax code, how would this be paid across to the receiver? Would my employer need to deduct this from my salary?

You need to include them all, which leaflet were you reading, it sounds like it is out of date

The NT money is paid to you and the OR appoints a solicitor called moonbeever to arrange collection, usually by standing order

I have been looking at various websites and they all agree that benefits are not used to pay into a bankruptcy.
While the child maintenance would be looked at as a part of the household income, it would not be used to pay into a bankruptcy.

Is this correct?
