 When should I inform OR of my cancer diagnosis?

Hi Everyone.

My husband and I will be automatically discharged from bankruptcy on the 11th November. In the meantime I have been diagnosed with Cancer. I am currently off work and my pay drops next month to half pay. We both have an IPO, mine for £240 and my husbands for £100. We have only just paid under a year of this and it needs to be paid for 3 years, but there is no way we will be able to pay it while my pay is half. I am a teacher and the highest earner. I want to inform the OR straightaway, however my husband thinks we should leave it till we are no longer bankrupt, as otherwise they may increase our bankruptcy to longer. Are they allowed to do this? I am scared of doing this, as the payments go out on the 14th of the month for the IPO and I will not be able to cancel it in time if I wait until after we are not bankrupt on the 11th. Any advice would be welcome. Hope this makes sense.

I'm so sorry to hear your news Louise.

You need to contact them straight away, your bankruptcy will not be extended. You will need to go through a new income and expenditure and your payments can be reduced or stopped.

You should definitely inform the OR straight away and your BR will not be extended.

Louise,
very sorry to hear about the diagnosis,and I too hope the treatment goes well.

As for your IPO/IPA, you should tell the OR as soon as possible, particularly as in the IPA proposal there are undertakings asking you to inform the OR as soon as possible of any change in your circumstances, involving your earnings, especially if it goes down.

As Viki.W and gettingoutofdebt said, your bankruptcy cannot be extended. That can only be done by a court, or you agreeing to it if there has been any misconduct, on the face of it, there doesn't appear to have been any.
