Hi
I'm a little confused at the mo!! (Doesn't take much!!!)
Me and my partner were made BR on 09/10/09. So I was assuming that on that date this year we would be discharged, as BR only lasts for a year. However, we have heard nothing from anyone - no letters, no phone calls nothing.
What are we ment to be doing? Does the OR contact us to tell us we've been discharged or am I meant to phone and ask?
I know that we have our IPA for 3 yrs but thought that I had to get a discharge certificate or something.
Any help would be greatly appreciated.

You won't hear anything from the OR to confirm that you have been discharged as you had automatic discharge. They only write to you if you have early discharge.
If you want a certificate of discharge you will need to apply to the court that made you BR, and there is a fee of £60 (I think) for this. I just printed the entry from the Insolvency Register showing that I was discharged.

Sometimes, not always, if you receive an Early Discharge (ED) you will receive notification from the OR. If the discharge is automatic (after 12 months) then you won't receive notification.
Have a check on the Insolvency Register to see if your details are still there - http://www.insolvency.gov.uk/eiir/
If your details aren't there then it means that you received an ED more than 3 months ago.
If they are they should show you as discharged so print a couple of copies of the form off in case future creditors, banks, etc. want proof that you have been discharged.
Other than that it is a case of continuing to pay the IPA. You will still need to inform the OR of any pay increases/decreases until the IPA has finished. You can also start to clean-up your credit file from the instructions at http://forums.moneysavingexpert.com/showthread.php?t=677875 but your BR debts won't fall off the credit file until 6 yrs from the BR date so there is plenty of time for the credit clean-up. |

i would personally get the certificate of discharge from the court and send it to creditors it seems to complete everything then

The Insolvency Register is still unavailable due upgrades the Insolvency Service is currently doing. It was supposed be back up on Monday, then Wednesday, if it's like other upgrades don't hold your breath!
