My partner was made bankrupt in January 2010 and since the new tax credit form was submitted (July 2010) we haven't received any working tax credit. I have now sent his self assessment for the last tax year to hmrc but don't know if this will get the working tax credit element released or if it is lost? Can you please advise because I am really struggling and the stress is seriously affecting my sleeping/eating & relationships with family and children. Any help would be most appreciated, as I don't want to use cheque cashing centres for the childrens Christmas unless I really have to. Thank you.
Are you sure they had the form in time. The WTC is separate to the bankruptcy so I would be ringing thetax credit people to see what's happening. It sounds like you may have lost out for this years money as you should have heard by now & you may need to submit a new claim.
BTW do try not to do any cheque cashing because you could well find yourself in the same situation you were in before your husbands bankruptcy. Your children would rather have happy parents than toys, believe me.
Have you received an award notice for 10/11 yet? If not suspect your renewal has not been received. The submission of your husbands return for 09/11 will not trigger a recalculation now. I would advise you to phone the tax credit helpline and ask why they are not making payments. I know that there was a 60 day extentsion of the renewal deadline to 30 Sep and they will only renew now if you plead exceptional circumstances eg breavement or hospitalisation. Its important that you do this as if they are not making payments because you failed to renew they may ask for back the payments they made during 09/10. Your bankruptcy has no effect on your tax credits,Hope this helps
