I went bankrupt about 2 years ago, I decided not to buy the beneficial interest due to the current market. What happens with the property? obvioulsy I am still paying the mortgage, do I still own it? do I have to contact someone to get it transferred over?
also I did not hear that I had a BRO,although this was spoken about at the time of bankruptcy. so do I assume since 2 years have passed, that I have been discharged after the usual year - as I have heard no different?
thank you in advance for any help. |

Hi nearlyover
As you haven't heard from the OR's office for such a long time, I think that you can assume that you were automatically discharged after the year. However it might be a good idea to look at the bankruptcy register at www.insolvency.gov.uk
The Official Receiver can keep an interest in your home for up to three years. However if you have intimated to him that you do not wish to buy the beneficial interest, he should have told you the next course of action. Are you still living in the house?

Hi nearlyover,
although a BRO may have been mentioned at the time of your bankruptcy, the fact that you haven't had a second or further interview indicates that although the examiner may have recommended further investigation(FI), the OR may have considered it not serious enough(plus the recent shedding of jobs at the IS, means that for FI, the misconduct must be really serious)and the most you suffered was no early discharge.
As for the house, your case will have been transferred to an RTLU(regional trustee liquidator unit) who at the 2 year 3 month point will review your property to decide what to do with it. What they do depends upon its equity position. If it's still in negative equity and depending on by how much, they may begin the revesting procedure before the 3 year point.
