Hi guys

I went bankrupt in 11th feb 2009 and discharged 15th oct 2009

Every bank has marked my account as satisfied and not marked the account wi a default.

HSBC have a default on my account after the bankcruptcy date (all payments were made up until the date of the bankcruptcy)

The ir and myself wrote to them with a copy of my bankcruptcy cert from the court however they did not close the account down. It's still showing as defaulted. I wrote to them and they have sent me a letter today saying that they have not received my default certificate u til this week swill change the default date til 11th feb 2009 and mark it as partially satisfied and it will take up to 12 weeks to change on my file.

Is there anyway I can get the default removed.

I had accounts with other banks with a lot more debt and they immediately marked the accounts as Satisfactory and settled.

Is there away to appeal to get the account status changed?

I've applied for a mortgage which they have agreed wi everything apart from the default showing, they said if it is marked as satisfactory and settled they will give me the mortgage offers?

Hope someone can help

Can you show the mortgage company the letter from HSBC, that way, they have proof that HSBC are going to alter it but it will just take time.

Not sure what else to suggest, sorry.

They have said with it showing a default still even after they have changed the dates etc they won't give the mortgage until the default is removed, however if they mark it as stratified and settled they will give the mortgage offer

So as it stands now it has been marked as partially satisfied? Is this acceptable for your mortgage company as if not I don't think they are legally obliged to do more.

I am still a bit confused as to how if they know it has fallen under the bankruptcy why it is an issue with your mortgage company?

The default should be no later than your date of BR and won't drop off your credit file until 6 years from that date. As RHB says creditors are only legally obliged to mark an account as partially satisfied, they don't have to mark it as satisfied.
