 Hello. Applying for a joint account after bankruptcy

Hello,

I was declared bankrupt in Jul 2007 and discharged in Dec 2007. Since then I have had an impeccable credit record and managed my finances well. I have 2 questions that I wondered if someone could clarify:
1) Is bankruptcy wiped from a credit record 6 years after the date of bankruptcy or 6 years from the discharge date?
2) I recently looked into applying for a new joint account with my husband but didn't go ahead with the application as one of the 1st questions it asked was whether either of us had 'ever' been bankrupt (note, not just in the last 6 years) - to which I would have to answer 'yes'. If however, I reapplied after the 6 years is up and it's no longer on my credit file, how would the bank ever know whether I was or not? I don't want to lie in the future, but I feel that I have 'served my time' and if its no longer on my credit history how can anyone know?

I would really appreciate any clarification as at present my husband and I have been careful not to be linked financially to preserve his outstanding credit history and it would be awful if I were to jeopardize that by assuming that there are no records after 6 years.

Hi and welcome.

It is six years from the date of the bankruptcy not the discharge.

If you are asked if you have ever been bankrupt then you should answer honestly and sometimes the banks keep records way past six years so could possibly find out.

It won't fall off your record until this summer anyway.

I wouldn't apply for a joint account until the BR has dropped off your credit file. I'm planning on applying for a joint account with my husband later this year but we've managed without one until now so it won't hurt to leave it a bit longer.

Regarding your questions, Niobe is right, the BR will drop off 6 years from the date the BR was made. You will need to check your files to make sure that there are no defaults showing and, if there are, get them removed.

Once the BR has dropped off your file this will not affect your husband's credit rating as the CRAs won't have a record of it. However I wouldn't suggest lying as, if you are found out, it will cause a whole host of problems.
