Hello,
I am delaying to my cost going bankrupt as I wouldn't be able to handle this going into my local paper but I have read that this may change.
What is the latest news/timescle on this issue

Thank you

Hi Will,
There was a thread on here about paying an extra £30 in court and then the judge can deny the right for them to publish your details, but I think you have to have a valid reason, it cannot be just because you dont want your local community to see it!
Welcome to the forum.

Hi will as Maxine has said if you have a valid reason the Judge can make an order that it won't go in the paper. Have you already been in an IVA this sometimes makes a difference as your creditor already know about you. If it makes any difference at all it is a very small advert. No one mentioned it to me that they had seen it and the some of the people I know would have made a few comments.

I think we are a long way away from bankruptcies not being publicly advertised - it is a statutory requirement to do so and changes to statute take a long time to effect.

For an informal chat about any financial difficulties, or advice as to the options available, I can be contacted via my website - www.melaniegiles.com

Thank you for your replies so far.
No I haven't been in a IVA I wouldn't be accepted due to lack of any Income.
Someone mentioned to me and I read somewhere that the fact of having to list in the Local paper was going to be stopped sometime next year and it was going through parliament but I haven't read anything since.
If someone can point me to the Link on this web site I would be grateful.

Melanie,
Thank you for your offer to assist, but I,m beyond any help it's the local papers which is the only thing stopping me from going bankrupt it could push me over the edge.

Hi Will,

It was mooted prior to the last budget that the Chancellor was going to stop this. Come budget -time, no announcement and no indications of this being brought in.

There is half a chance that it might not go in at all (in your local paper), mine did not go in, the local rag comes out tuesdays and fridays and it did not appear, i went bankrupt on a thursday. there are also regional newspapers with local editions and as far as i am aware, it did not go in there either. don't let that stop you anyway, the worry of paying the creditors is a lot more than that of possibly being discovered in the paper. eventually you will decide and it may or may not go in, you should do it now if that's all that is stopping you.

The OR arranges the advert, so talk to them if you have a concern. However, they would want a very good reason not to place the ad.

Julian

I don't think that budget announcement referred to the advertisement of bankruptcy orders - but did relate to some of the other needs of public advertisement in insolvencies such as notices of dividends and annual meetings in liquidations. I feel it may be some time (if ever) before public advertisement of bankruptcies is repealed.

Thank you for everyone's input and replies I didn't realise for a £30
fee the OR may consider not placing in the Local Paper

Julian
Your explanation is what I was after, unfortunately not the one I wanted to hear
Thank you
