Just got back with a follow up appointment with the CAB, who were asking my plans for BR.
Before i go any further i would like to add she did seem to know what she was talking about but seemed funny with me at first.
She told me that 'if' i get discharged after a year the house will still be the 'property' of the OR for a further 2 years. I really didnt know this - when i said my husband will buy the BI of the house she told me the fees were £1 plus about £600 court costs if we were in negative equity, but doesnt think that the or will give us the option. Im terrified that they wont allow my husband to do this and the house will still belong to them even once i have been dis-charged. She also said that if the OR were to ask my husband to buy the BI it would take a long time to ask him - can i not request this on my BR date??
Im so scared that we will loose everything because of me and feel that BR is now not an option - i have no other options left now and am sooo scared and feel like im back at square one all over again

Im scared of being told that the CAB are right - we cant loose our home because of me. I will have to think of another way round it. Im not even earning but could i not just carry on paying token payments each month.
Can they really force the sale of your house, even if there is little equity in it and if someone is wlling to buy it

By the way there is no equity in it, but cab said they will probably hang onto it anyway, for when the fixed term ends and they can force the sale

I just wanted to say thank you very much for telling me to phone your helpline - im sorry if i seemed to panic, however, when the CAB tell you something and sounds like they know what they are talking about then you believe every work they say.
I spoke to a very kind and helpful man, who made things clear to me

ALSO - does anybody know if this is correct - again CAB advice.
I had my food & cleaning at 550 per month for a family of 4, and she told me to increase it to 700 . . is this right?

hi moneyworries just to say the cab do not always get it right, when i went tothe court for my br on thurs there were 5 other people there declaring br on the same day 2 had absolultly no idea what they were doing and 3 others had been to the cab office in the same town and were told 3 different things because i had been reading on here for a few months i had a good idea of what would happen and the day went entirly as predicted by the people on here who have very recently gone down the same path i know iwould not have got through the last few months without the help,and support of the people on this site, i hope this help in some way during this very stressful time, things will get better with time and patiance |

Thank you for your kind words eamonn.....i certainly agree with you regarding your cab comments, however i believe they can do alot of good. Something like debt and bankruptcy is a completely different matter of course.
I have found so much comfort in these sites and visit daily just in case there is anything i need to know, but have forgotten. People here stand by and do not judge each other
