I am in an iva and have been made redundant and missed 6 payments.
I have received bankruptcy proceedings from supervisor who will not answer my phone calls or letters.I am going to court to defend my position and suggest to judge a 6 month break from payments during which time I will have found a job and start paying again. Any thoughts

Hi RDC

If you dont mind me asking who has started the proceedings, is it the IVA company or one of your creditors.

Also who is your IVA company dealing with your payments.

iva company started proceedings The company will not respond to my letters or calls. They are called x l of Bradford

This company in Bradford obviously dont have your best interests at heart,do they.

I would go and defend your position and also mention at court that you have been unable to contact them to discuss this matter.

Did you want to go BR, have you got assets that may be in jepordy.

I hope that you can get hold of these people, if not go to the court say your bit as you have to me about a break from payments and see what they come up with, they would rather have something from you rather than the debt get written of in BR where they will get bascially nothing.

I have been to court and judge was sympathetic and gave an adjournment of 4 weeks.A lot of people would have felt threatened by these solicitors letters just bullying tactics by a very poor supervisor.
I will keep you in picture.

Hi

as Jo says, have you any assets?
That might explain the IP avoiding your calls.

In IVA they get a set fee, in BR that same IP, if appointed your trustee in bankruptcy, stands to make a good deal more in fees.
