I went bankrupt june 9th. I had a phone interview with my O.R and was told My bankruptcy would last 1 year and I would have to pay £55 a month for 3 years. I called my O.R 2 weeks after sending paperwork he had asked for to find out how and when i would start paying the money. My O.R was on holiday and they had not recieved the paperwork. I was sent me new papers to sign and had to send in any of the paperwork i had copies of. I sent what i could recorded delivery. In september I recieved papers telling me that a different branch would be dealing with the £55 and that i should get in touch with them. I did and they had no paperwork on me and that i would not be able to back date payments. I received a phone call from an O.R 2 weeks ago telling me he had taken over my case and that he needed to ask me some questions and due to being really ill and not having enough sleep i began to get upset and angry and had to ask him to call back. He called back and my mum answered the questions for me and explained to him why i had to go bankrupt and told him i was still waiting to pay my £55. He said he would sort that out and was said to have seemed ok on the phone. On Friday I received a letter of application from him offering me to except a bru for 3-4 years. Even though i am willing to except the bru practically all of the dates, sums and things myself and my mum have ment to have said are lies. Because of this I do not know whether to fight or except? All visa debts were paid upto one month before bankruptcy and the mortgage was paid upto 2 months before. Even though all debts were in my name, they were joint , jointly paid and the only reason I could not continue to pay was because property did not sell even after putting the price down 3 times and because my x could not pay his share no longer. I could not afford to pay alone! What do you suggest? It took 2 weeks for me to get an appointment with C.A.B for bankruptcy!
Firstly i would reccomend a call to someone in the know about BR and BRU's like our helpine which is free and if they cant speak straight away they will get back to you just leave a name and a number and someone will contcat you, that number is 0800 078 9367.
Secondly i do know where your coming from, when you think you have one thing sorted others seem to pop up, and like you have said if you accept the BRU then that must be the right thing, but i do think you should with correct advice challenge it, the OR is not the law and you have rights too.
