I helped someone through their bankruptcy and a few months after the order was issued the Student Loans Co paid an instalment of their loan into the closed bank account. The SLC found out that the money had been accepted into the closed account via a bank manual override. The SLC tried to get it back we have been trying since 2006. It will be a debt she will have to repay to the SLC if it is not handed back to either the SLC or given to the student who was assessed to receive it. NatWest have given us the run around but can they accept this and keep it ie make remedy after the bankruptcy? They have never told us why they are holding it and even if they are offsetting it against the overdraft. They keep losiong aur thorisations the (mow ex) student gives them to enable them to speak to me (she has a mental illness which is why I helped in the first place)
Any advice appreciated

Hi there

I was under the impression that once a person is BR the bank cant keep any money paid in after to off set it against the debt that was included in bankruptcy??

Im really not sure of the answer but this doesnt look right to me. I will bump it back up a little for you tho

Hi Elaine

Welcome, i was just wondering have you been given permission to speak to the OR about this persons BR, if you have then the OR should be dealing with this now and not you.

The Loan was done a while ago 2006 so should have been dealt with by now. I would get hold of the OR again and get them to try and get this sorted out for you.

There may be another way but thats all i can think of right now, maybe one of the other experts will have more knowledge.
