hi all could you please give an insight as to what happen re the OR and interview etc, we are so worried about what happens to us and what to say, i can not pretend this was not all our fault, too many years of nice holidays, cars and trying to give our kids the best in life, my only defence is that with my hand on my heart we honesstly believed that we could afford all the credit cards and loans, and it is really only the last few months that reality has dawned that we are dreaming, and really cant afford it all, how do we explain our totally stupidity, and what will happen to us ???

Hi Jo

That sounds so familiar, we have all done what you have done. The OR is not a monster and is there is gain the facts and present this for the creditors.

The main thing is to be honest, you will need to try and work out what actually caused you to find your really struggling like a redundancy or marriage breakdown for example.

The OR will ask what happened and then try and piece together a report for sending to you old creditors. Each persons reasons are different as long as you have not been stupid and just lived the high life then within reason the OR wont be too hard on you, if you have had lots of expensive holidays and expensive cars that you have taken when monies were really tight and they do look back to see for themselves then you should be ok.

You must be honest and not hide things as they can find things out, dont start worrying about the OR though, we all have our reasons, mine was money went on my house and then i ended up ill, lost money from wages and started to struggle but have not with the exception of a catalogue added to my debts within 18 months, only about £1400 last dec for christmas and household items.

The OR seems to be one of the scariest things that as someone contemplating BR seems to make us feel the worst, but at then end of the day they need to know what happened and why you became insolvent and now had to declare BR.

They are not there to put you on trial, they have a job to do. Dont be scared, just be honest, the worst they could give for recklessness is a BRU/BRO which is a slap on the wrist and stops you taking credit past the £500 mark for the duration that its in place and you would be restricted in some jobs.

Dont worry it will be ok. :-)

thanks jo, we just feel really sick at the moment, what with trying to sort out a new home and all that goes with it, the strain is just too much, i cant wait to have it all over and done with. i am sooo scared of what to say, because is is all down to us believing we could cope, but as you know life has a habit of pulling the rug !!! and now we simply just can not afford it anymore, always robbing peter to pay paul and so it goes on !!!

oh well i just have to face the music now

Hey Jo

I do know what its like, i am 4 months into my BR and still although life is getting better i do know where your coming from and christmas does not help either.

But it will all be ok, you have to be strong and try to be better than these creditors, you have tried thats the main thing, you have to concentrate on your kiddies and making sure that thehy are safe and secure, sod the rest they can whistle.

yeah jo,
christmas is the problem at the moment my kids have been used a good life and now all the money i have from not paying the creditors etc is being used for the new house upfront rent and deposit, moving costs etc, its just bad timing its christmas, and i just can find any extra money for pressie's, and they dont understand, their xmas list is still a mile long LOL ! some people have said use whats available on the credit cards to do it, but how can i explain that, when i know full well, that i have no intenton of paying it back ?

would be able to do food shopping on the credit cards and get away with it ???

Hi Jo

I used my catalogue, as long as you limit what you are spending and say do £100 each for the kids and look for offers then the OR wont frown on you, they know that you have to live.

At the end of the day, family comes first, if you feel that this is what you must do then do it, i know i did not use CC but i used a catalogue, they will ask i know but if you tell them thats what you used it for then im sure they will be ok, just dont spend £100's on the kids as that will NOT go down to well.

My kids have been fine, they have long lists and i have 3 also, they know santa is on a budget this year and that its not about what they receive its about FAMILY and they have been fine.

Its how you handle them, kids dont need everything, they need love and support, not material things, buy for them yes, but just limit what they would have, they will be fine.

My feeling on this matter are pretty much the same as “Needafriend”. I was also very nervous about my OR interview having quite a lot of debt. My debt built up a 20-year period and I used credit cards for most things, always believing that I would be able to pay it back. I then started to draw from cards to pay off the minimum on cards, using credit to pay my debt, which is a recipe for disaster.

I realised during the last 12 months that I had a problem and would never be able to pay all my debt back and had to do something. I never used the borrowed money for gambling or anything too extravagant. Most of my debt accumulated by paying off debt, which I think happens to a lot of us who get into this situation.

On the day of my interview I expected to get a telling off by spending too much money on credit cards over the years. It was nothing like this at the end of the day the guy who interviewed me was very friendly and understanding and said at the beginning of the interview, he was not there to have a go at me but just to establish the facts as to why I went bankrupt. I think the problems arise when you try to pull the wool over the OR and try to hide things.

Just try and be as honest a possible and answer all the questions to the best of your ability. I would advise only to answer the questions asked by the interviewer and do not rant on about other things too much that might be irrelevant or might get you into trouble.

Good luck with your interview and I’m sure everything will work out OK.

what im gonna do today then is do food shopping, o a cc as i had put by £100ish for it, but use that money instead towards xmas for the kids then i will be able to say to the OR that we needed food and due to all the cash being used for the new house we had no choice but to food shop on the cc.

i feel a little better now, thanks so much jo x
