 hi, i missed a mortgage payment

hi, i missed a mortgage payment at the end of december and thought i had arranged paying £100 extra on top of my usual mortgage payment starting the last day of january i have a letter confirming this then today i receive a letter saying i owe double the arrears (2 missed payments)its not due till last day in Jan. and that if i dont make a acceptable payment proposal my account is going to be placed with solicitors and i should contact the local housing authority. we want to try and keep house when we go BR its in neg equity, but ive really been thrown by this new problem, also had summons for our council tax in feb, dont know whether im coming or going nearly had a heart attack this morning ive calmed a little now though, some advice on what mortgage companys can do would be great, thanks v much

Ring them on Monday, find out where they have calculated the two payments ffrom.

Hi

it seems you are finding things quite a struggle.
Think carefully about your property, mortgage etc.

Are you behind with the mortgage and council tax because you are servicing payments on unsecured debt? If you are and intend to declare bankruptcy then stop paying the unsecured debts.

If you've already stopped you need to consider if the property is affordable. If you declare bankruptcy with the full intention of staying in your home, then sometime down the line you are repossessed you could be facing bankruptcy for a 2nd time once the repossession and sale takes place and there is a shortfall on the secured borrowings after the house is sold.

hi, thanks for the advice,i will be ringing on monday just got in a panic..... once all the unsecured debt is out the way we can afford all the usual outgoings.. mortgage, c tax, utilities,living expences. I missed the one mortgage payment in dec to go towards the BR fee but it didnt work out that way our debit card was used fraudulently and we had to use what we had saved and the time the money was paid back other things had cropped up that needed to be paid. Im still paying some of my loans + creditors, the council tax £290 i havent paid because i was thinking of adding it to the BR but not so sure now we have a summons. we would really like to try and keep the house thats the most important thing in going BR especially to my OH .. do you suggest i just pay nothing to creditors and ignore the phonecalls and letters. hopefully BR feb/ mar. thanks v much

also is it only the mortgage company who could reposess us for missing the mortgage payments i did mention to them i was considering BR should i not have mentioned it? i have only missed the 1 payment?could they do this for 1 missed payment? thanks

Hi

the morgage lender will not be interested in your pending bankruptcy, only in the repayments. If you keep paying they will be fine.

To safeguard your house put your mortgage, and council tax, payments first. If you could comfortably continue to pay the unsecured lenders then you should do so. If this is proving difficult to impossible stop paying the unsecured debts.

hi, thanks for your help john, i might sleep a little better now, my main concern is protecting my girls as well,one is doing her GCSEs soon and i would hate my mood to affect her, they are both so special. thanks v much
