I owe Barclays 57000 pounds and they have sold my debt. The new owner has threatened me with bk. I have offered terms of 1000 pounds now, 5000 in 1 month and the balance in a further 6 weeks. Thet seem reluctant to accept, should I get a lawyer of do anything else in the meantime? When will they let me know if this is an acceptable offer?...I have no assets

Hi there Stewat and welcome to the forum

Do you have assets that could be at risk with br, as they are only likely to pursue the threat if they are sure they will get something back in return.

Are you in any other debt or is Barclays your only creditor ?

Is the return your offering even manageable to you ?

Sorry for the questions however if you could supply a little more info then that would help.

Take care

Jenny

Do your outgoings exceed your incomings with this debt ?

Im not sure how you could hold them to it and not even sure you could - the only real way to make things legally binding is through an iva and unfortunately i dont know the ins and outs of them, but know it has to be dealt with through an ip.

If you are going to struggle to meet those payments as well as any other commitments then br is a possible route for you and if you have a disposable income of £100+ per month then you will only pay into an ipa/o for a maximum of 3 years.

Hope this helps

Jenny

Hi Stewartd and welcome to the forum.

Where is this money coming from? I would be surprised if they decline your offer, so be prepared to stand your ground when you speak to them. If you're unsure how to proceed, please feel free to speak to one of my colleagues on the helpline (see post entitled "HELPLINE").

Hi Stewart

The helpline is down at the moment, but if you go into the post entitled HELPLINE as Julian has suggested then you will be able to email.

Good luck

Jenny

HI Stewartd

The experts on here will advise you better than i can but if 57000 is the full amount i would be thinking of offering less than this as a full and final settlement.
