I went BR on the 29th Jan, everyone has been fine apart from the Halifax, (or the wallyfax as I now call them)!! I have told 3 of their departments of my BR, given them the case no. and court but they continue to call me. I have had 8 calls today, I refused to answer the security questions to one guy and I put the phone down on him, an hour later I had another call, again I refused to answer the security questions, telling them to stop hassling me and that I have already informed them of my BR. He just kept pressing me for the security questions when I continued to refuse he put the phone down on me. They obviously haven't heard officially yet as I haven't had my interview but I have told them I was BR the day after I did it. I think I am right in thinking that they are breaking the law. Any opinions or advice please.

This is what Julian has posed in an earlier thread :

excessive calling can be deemed as harrassment which is a criminal offence under Section 40 of the Administration of Justice Act 1970.

Threaten them with this and they may change their attitude.

Hi At

yes they are technically breaking the law.
Debt as we all know is a civil matter.
Harrassment is a criminal matter.

Section 40 of The Administration of Justice Act 1970 says so.
You could try quoting it to them next time with a suggestion the police will be notified if they do not refrain.

Alternatively, google the act and cut and paste section 40 into a letter and send it off.

I would be surprised if that didn't do the trick.
You shouldn't even have to consider doing this but if it really is bothering you then give it a try.

I know it is very annoying going over the same old ground time and time again, when creditors phone up after bankruptcy. I also had this happen to me, but I generally looked at the phone number on the display and did not answer it. In some cases I sent the creditor a copy of my bankruptcy order which might a good idea and this was suggested by OR’s office.

Things did not start to calm down for me until after my interview with the OR. I think the OR waits until after the interview before informing your creditors.

So again I would send a copy of you BR order to them, that may keep them quiet until they hear from the OR

Thanks for your replies, I am tempted to say to them what John has suggested in his message. Can I still threaten them with this even though they haven't officially had any contact with the OR? I have given them the court and no. etc. I am just so angry at the moment.

I know how you feel, just take it easy and don't let them grind you down, no good for the blood pressure.

You are debt free now and things will soon calm down.

we were rang a couple of times after B/R
by halifax kept going over the same thing
no /ect in the end the lady gave us there
B/R dept number which we rang
no more calls

Well at 9.00 am this morning I received a call from the Halifax, after a heated conversation I read the 'Administration of Justice Act' as John advised, and then put the phone down. Would you beleive half hour later they phoned again!! Have these vultures no morals? Sandie

if, or should i say when, they next call ask them for the bankrupt dept number that Guss referred to.

Failing that, do you still have the number to hand Guss?
