Just a quick question,
I have looked for the answer but to no avail.

After you are discharged from bankruptcy can you apply to the banks/credit card companies to reclaim all the exorbitant charges they applied to your accounts before BR.
I'm aware that if you were to do this before discharge you would have to pass the money to the OR, but what about after discharge?

i'm sure there will be some people who will think that "you've made the banks lose money by going BR now you want to try and get more money from them" but in all honesty the way the banks have been with me it does not bother me one little bit.
Even before my situation got to the stage its at now the banks used every opportunity to charge a nice fat fee for themselves, quite a lot of which i have paid for. It has been proven that these charges are illegal so i think i have the right to claim it back.

Your thoughts are appreciated

Hi

for my part I think it may well be a waste of time as even if successful they would likely only wipe the sum due off the debt you had with them at the time of bankruptcy.

Technically once you are discharged those debts are written off but what is the reality?

Once discharged the OR is no longer involved so who will fight your corner and at what cost?

I agree with John. As the debts have already been written off it's probably best left alone.

I believe the court case about the bank charges is still going on isn't it?

Even if a claim went in, there's no saying when it would be dealt with.
