Hi all,

having decided bankruptcy is my best option can someone point me in right/best way to start the process, do i contact court direct, fill in forms on line or what ? just wondering everyone elses experience and how long (guess) do you think it would be from now to actually being declared bankrupt i would like to do it as quick as possible before creditor hassle etc.

Hi,

The process time varies, depends upon if there is a backlog at your local court.

I recommend that you give them a call to check to see how long it is likely to take.

You can fill in the forms online:

https://www.insolvencydirect.gov.uk/isolv/

This is the link which will get you to the forms.

You will also need £495 court fees.

If you have stopped paying your creditors, then you will get hassle straight away. You can politely explain what you are doing, or you can ignore the calls if you wish.

At the momment i am still paying all creditors but considering i am now going to start bankruptcy ball rolling when does everyone think it best to stop paying them and keep hold of little money i have left ?

If you continue to pay them, will you be able to afford the court fees?

Personally, I would use the money for your creditors to pay the court.

It is generally expected that individuals cease payments to their creditors once they have started on the bankruptcy route. You are not expected to meet the contractual payments on your debts and fund the Bankruptcy petition in the same month.

I personally think the best thing to do is to ring your local county court ask to speak to the bankruptcy clerk and request a pack to be sent to you in the post (all they are going to ask is your name & address) whilst on the phone ask when their next appt is and book it. I personally don't like the Insolvency service website forms to store until completion as i have heard stories of forms disappearing(and you've guessed it after finally completing)or just freezing just usual IT difficulties - if there posted to you , you can spread them out ona table and take everything in slowly....well thast my preferred cholice, no doubt others will come along and post having had no problems with the online forms...
