Can anyone advise us wether or not Northern Rock can secure the unsecured loan part of our mortgage agreement on our property. They will be aware there are problems as they refused our IVA proposal. Payments on both the secured and unsecured loans are up to date.

Hi

yes they can secure their unsecured loan against your property in the same way that barclaycard etc can.

They would first need to pursue a CCJ, then eventually an Interim Charging Order the a Final Charging order. This will take at least 90 days

I suspect that we will see a huge rise in these over the next year

Thanks for your quick reply. We have a court date for our bankruptcy hearing on 03/03/2009, providing no action has been taken I am presuming we would be able to include the unsecured part of the loan in our bankruptcy?
