The home I used to live in, I couldnot sell. As I planned to go bankrupt in Feb when The 6 months of the tenancy was up I just said the the person renting my old home that we could just carry on. I going Bankrupt next Tuesday. How do I ask him to leave as I do not think it fare for the home to taken away from him by the bank with no notice.

Hi

your bankruptcy has no impact on the tenancy as such. If it is in negative equity the trigger will be the mortgage lender repossessing if the mortgage repayments are not met. How far you are in arrears will therefore dictate how long your tenant can remain in the property.

I am up to date with my mortgage. I will be one month behind as I will not be paying this month becuase of going BR on 24 Feb. Can I use the rent he will pay me on 23 to pay for my BR or as I should pay this to the Northen Rock I sould not take the rent.

My plan is to give him one months notice once I get next month rent to pay my BR can I do this.

Hi

you can use the rental payment towards your Br fees, however if you are planning to hand back your property then all future rentals need to go to the mortgage company with any excess going to the OR
