My wife (who i am currently not getting separated from but this prospect changes almost daily!) is in the early discharge process. She has sent in the IPOQ and EDREV forms. She has been advised she will not be getting any further ipa than the nil tax code one she is on until end of this month. The OR office has said that the forms are with the court but they can't say anymore about it. OR said the forms were there as of about 3/3/09. Does this mean the court has a pile of papers to go through and will eventually stamp her form if the judge is happy to and then tell the OR who then sends out the discharge letter and updates the website?
Could there still be a spanner in the works or is it just to wait for the court. She was always slightly worried about a BRO but I am guessing that they could not have sent forms to the court asking for a BRO unless they had already discussed a BRU with her?
Fingers crossed this is going ok. Any ideas please? |

HI,
I would be interested to know the process of early discharge also.
We were advised by our OR that he will send us the forms to complete at 3 mths (from when we first petitioned for BR, which should be 3/05/09) and emphasised that its very important to complete them immediately and send them back. He said they would then be forwarded to the secretary of states office (??) to apply for early discharge, he thought there was no reason why this wouldnt be granted. Which is great!
But how do you end up finding out the outcome? Does somebody advise you, if so who would it be or should we just keep checking the register?
Thanks

Just to let you know what happened in my case, I was not working when I went bankrupt so had no IPA, as such, I did not get a ED form to fill in, I just happened to be checking the insolvency register (about 5 and half months after bankruptcy) and I noticed I had been discharged early! A couple of days later I received a letter telling me
In hubby's case, he had a Nil tax IPA and the OR did send a ED I&E form to fill in, about 5 months after bankruptcy, we filled this in exactly the same as at the start of banruptcy but the OR tried, from this form, to get an IPA, we contested it and they dropped it in the end and then hubby also got ED too, about one month after me. |
