Hi,
I have had a 4 year BRU offer for gambling. I was resigned to accept it, but on other forums people have suggested that they may not want to spend any more money on the case and so have offered a BRU, and that if I fight it - I may not automatically get a BRO (or a submission for one to court). I have been advised that BROs for gambling are actually not clear cut and are not necessarily automatic.
Just wondering if I should stretch it out somewhat, or try to dispute it as I did manage to pay back 20K of 76K in a DMP, did go to the GP and get put on Diazepam (not repeat, just once) - have not gambled since for 3 years....and only went BR after creditors refused to freeze interest and refused final offers of 75p in pound (from family members).
Doctor has screwed me over, saying "no evidence of compulsive behaviour", but I would ask why he would make me an appt to see a cognitive behavioural specialist if this was not the case. I would also question a statement in the BRU, that states that after gambling 60K previoulsy (which I cleared with my half of equity), I then went on to gamble again - so must have known the risks. I would say that that is evidence itself of compulsive behaviour. To have gambled your house away, to know full well the risks and dangers, and then to carry on an do it all again. Also I don't know if they can mention my previous experience of gambling. After all, I paid this off with my own assets and so what has this got to do with the BRU or my BR?
Any advice appreciated. I have accepted I should get one, but now am wondering if this is the case.

I am going bankrupt and worrried about gambling on and off last 3 yrs lost around £2000

I have just been given 10 years BRO for gambling an overpaid wages,despite not gambling for more than 2 years.the reason for my BRU is the gambiling and not disclosing an overpaid salary and spending it.I know for sure I was a compulsive gambler, but during these BR procedures they seem to be not interested in such issues as being an addict gambler, which is harsh in terms of punishment.I think your 4 years is a pleasant journey compared.You can fight back,but I have been told that it is left for the judge's discretion to decide.I had enough and did not feel like risk it and go through the torture and anxiety of court procedures. good luck.

Hi abd,
10 years for gambling sounds really harsh. I too, am waiting to hear if I get a BRU as most of my debts is a result of gambling. I haven't heard anything yet, 4 months into BK, but if I received 10 years, I'd be mortified.

Sorry for replying after ages ,I got the 10m yrs for 2 reasons, one not disclosing an overpaid salary and then gambling .I guess my case was unique and exceptional- well i have noticed that long ago as everybody is after my head for the last 3 years . wish you all the best. |
