i just read in the other thread that .. in order that any shortfall in your property to be included in bankruptcy the house first will be repossessed .. my situation is my bancruptcy is scheduled on april 1 @ 10 am .. and the repossession of the house is on the same day april 11am ... do i need to cancel my bancruptcy schedule so that any shortfall will be included or it's ok to proceed ... pls advice .. tnx

when did you last pay the mortgage?

I was told by CAB to wait until my house was repossessed and sold before I went bankrupt, but this is not true, as long as you have stopped paying the mortgage it will be ok

this is the reply I got from the Insolvency Service:

Any shortfall arising from the sale of a property which was owned by the bankrupt before the date of the bankruptcy order will become a bankruptcy debt. This is the case no matter how long after the bankruptcy order date the property is sold.

last 3 or 4 months in arrears ... so i will proceed then w/ my bancruptcy .. my major concern is ..i want that any shortfall will be included .. tnx ..
