hi guys, we went br on 16th march and had or interview over the phone 2 weeks later, he asked about the car and said it would be exempt (£1500) but said he would send out a letter with a list of thing we need to send him (proof of car tax, insurance, mot) he also said he would send another form for our expences and warned us we wouldnt be allowed to claim for such things as hair cuts and school activities, bit harsh i think....especially as we have 3 young daughters!
anyway, 2 months later and we still havent heard anything!!
has anyone else experienced anything like this?
also, one of the reasons we went br when we did was to avoid the nt ipa, will the or be able to apply this now that its a new tax year?

Hi Mac,

The OR shouldn't be able to claim the NT IPA as you went BR in the last financial year and (I think) they can only claim the NT IPA in the financial year that you went BR.

When you went through the I&E with the OR did it leave an excess of more than £99 so you would end up with an IPA? If so, don't forget that you can disagree with the ORs I&E and claim for things like haircuts and school activities.

It sounds like your situation is:

- You are not liable for an IPA
- You are not liable for a NT IPA

So the OR isn't waiting for any money from you so is in no rush to send out a letter to you regarding the car.

Don't forget that it is the OR who only has 1 year (the time before you discharge) to get any information from you regarding your car or an IPA so they are the one's who dictate the pace of the proceedings rather than you having to chase them. They are also extremely busy at the moment so this will delay things as well.

If I were you I would just leave things as they are and if the OR needs anything from you they will contact you. If you are worried about the car you can always send them photocopies of the documents to the OR. Their address will be on the BR certificate so just address it to the OR and put the docs in the post.

My car & my husbands motorbike was exempt so we didnt have to send anything to the or, we just had a letter to say it was exempt and they had no interest in them but my husband had to buy back his van for £50 so we had to send in insurance cetificate, mot & registration documents and they signed it back over to him.

That's good information ashford. I have been told that my car (valued by the OR as £1400, less by me) is exempt as I need it for my job but was told that I need to send a photocopy of the tax, MoT and insurance. I haven't received the request for these docs yet but it looks like another case of these guidelines being 'recommendations/guidelines' rather than stipulations but it does mean that some of us 'BR people' are dealt with more leniently.

the or requires the doc's for insurance and tax for the purpose of making sure that its being used and not just lying in the driveway, with regards to the i+e i mentioned.... the or has the copy that the court sent him, we did not go over this on the phone and he said he would be sending another form for i+e for some reason?? he did however say that i would NOT be allowed to claim for things like hairdressers or school activities, my origional i+e was taking my outgoings around £200 over my incomings.....im aware that he would have to take this down by around £300 to issue an ipa, just hope he doesnt try!!
