I travelled to Australia on a 1 year working holiday visa (I arrived on 3 December 08) I have not been able to find work for the duration of my stay and have not made any payments to my debt in the UK with HSBC bank totalling around 6,000 sterling. I have not been able to support myself for the duration of my stay here and don't know when I will be able to find work. Am I able to declare bankruptsy from Australia? I also am planning on going to South Africa at the end of my Australian visa and don't know when I will return to the UK so can't commit to paying off any of my debt. Please advise what the best way is for me to move forward?
As long as you have lived in this country at some time during the last three years, then you can declare bankruptcy but would either need to present yourself, or appoint someone as a Power of Attorney, who would do it for you.
With such a low level of debt you may be able to do one of the new debt relief orders which came into being in April, but I don't know how you stand with doing that from abroad.
