I went BR in February this year, and the OR said he had no interest in the car and that we could make our own arrangements with the company. We have not paid any payments since January and still have the car.
1/ We have paid over one third so I do know that it will have to goto court for repo....Would I be notified of this in writing?
2/ Just replaced tax disc....when car is repossesed....are we allowed to remove the tax disc, or does it need to stay with the car?
3/ Knowing car will be going , and being in rented property....should I change address on the cars documents?
Or if anyone can direct me to a legal type web site that may answer these questions I would be very gratefull.

P.S. Just to say thankyou to everyone who has given me advice...and also all the posts, where I have been able to get such a wealth of information...without which I do not think we would of managed BR as well as we did.

Hi there

you can always contact the HP company advise them of the bankruptcy and request they collect the vehicle (most companies won't do this until you are in 3 months arrears)any shortfall uner the arrangement will fall into the bankruptcy. This can save you going down the repossession route.

You 'own' the tax disc so are able to remove and claim a refund from the DVLA once the vehicle is no longer in your possession.

From a legal perspective the vehicle should always be registered at your home address so unless you are going to contact the HP company i suggest you transfer the documents to your present address.

Perhpas the HP company are writing to your 'old' address? YOu would be better off contacting them to arrange collection of the vehicle asap

Hi

You can ask the HP Company for voluntary surrender of the vehicle thats what I did with mine, they sent me forms to fill in and send to the OR, and then within 4 weeks it was gone

Many thanks to your replies
I did inform the company of my new address and that I was BR. We had tried to negotiate a deal to keep up repayments, but it just did not work out (they wanted us to repay a number of months we had missed, which was a bit tricky with £10 left out £1000 from BR).. Dont get me wrong I am not complaining, it has kept a family of five mobile for the last six months, which has now enabled us to save the money to buy a cheap car. Just seemed strange for them to have taken so long.
