Hi, I have been/still am considering my options and the more I read and learn the more confused I am as to what's best for me to do, I have 35k unsec debts due to lengthy court battle with ex for my kids which has left my stoney broke :-( final hearing in 2 months and desperately hoping for an award for costs (after judge finding in my favour already) which would be 10-15k and go some way to settling my debts but that's 2 months away and have missed my first payments this month, can no longer meet min payments but not sure if I can hang on waiting for something that may not happen whilst living on credit. Haven't maxed out on credit still have approx 4k left but don't want to use any of that as it doesn't sit easily with me! I read folk on here quoting dates they going BR, how does that work? do u decide when is best time to go BR and file for that date or does the court tell you when u will be filing for BR? all advice is much appreciated thanku and if i could appoint some1 to come in and make these important decisions for me I would

Hi,

You are usually the one who decides when you want to go BR and you would need to check with your local court as to whether or not you can just walk in, or have to make an appointment. You can fill the forms in online.

If you go bankrupt now, then anything you get awarded will have to be paid across to the OR (after any fees you may have to pay).

Do you own your own house, and is there any equity in it?
