Can any one help. I have reached the end of trying to keep my debts under control. I owe on average £38,000 through credit cards and hp. I am self employed and work has been good up till now, so i have been able to afford these debts...but work has allbut dried up and now the only way i see forward is to apply for BR. what will i have to show in regards paperwork. One of my debts was for cosmetic surgery for my girlfriend...what will happen about that? I have spent when i've had money, will that be seen as wrong of me....how long does the process take...please help

Hi there and welcome to the forum

If you have paid for your girlfriend to have cosmetic surgery then presumably she owes you a similar amount, and the Trustee in bankrutpcy will want to collect that debt. The Trustee will also look into your financial history to see if you have been reckless with your borrowings or simply have used extended credit to fund business losses.

What business are you actually in?

The bankruptcy process can be very quick - you just have to fill out a few application forms and make an appointment at your local County Court. The timescale will be dictated by your Court's listing, but should not take longer than 6 weeks.

Hi there - I have recently gone BR after years of struggling with debt and I can finally see the light at the end of the tunnel. I know you have a bit further to go yet and its a difficult choice to make but at the end of the day you solve your debt problems. Keep asking questions on the forum - there are plenty of experts/ members who have been in your position and will help you. Good luck!

if the cosmetic surgery was a gift and we are no longer together
what would i have to do. would they chase her for the money regardless. we wer due to be married and she never gave me the engagement ring back....where do i go from here? I am a Joiner and none of the debts are through the business.

Hi jay

from what I have understood reading other posts on here your kids stuff should be safe. I have read that the OR took a digital camera off of somebody and also a plasma screen off of somebody else but these items are of value. Also you can keep a car under the price of £2000 - £2500 anything valued over that then the OR will take it off you and sell it and give you enough to buy a run about.

As for the debt of the cosmetic sugery I think I read this earlier and I believe Melanie Giles mentioned that the OR would possibly seek to your ex to gain the funds from her.

I hope this helps put your mind at ease slightly. As I have said this is what I have understood from posts here on the forum.

Can I just say that you can only keep a car if it is necessary either for your employment or for looking for employment, for example I was allowed to keep mine as I wouldn't have been able to get to work on time using public transport.

Tomorrow is a mystery, yesterday is history, today is the present, a gift to make the most of.
