Advice please.

I am being chased by mortgage company to start making payments towards the repossession shortfall. The first payment was due around 6th August although I hadnt set up any form of payment plan with them.

I am saving for my bankruptcy fees and I dont know whether to tell them that I am going to be declaring bankruptcy just so they know and if I am lucky they might stop calling (think this might be wishful thinking!!). Also whether I should tell my other creditors?

Any advice on this would be much appreciated.

Hi I dont really think it matters if you tell your creditors or not, some of mine had not been paid for upto 6 months upto our BR.
They will prob still phone you for payment if you do tell them and will still do a short while after your BR even though there not supposed to.

The best thing we did was change our phone number and save the money we would of paid our creditors and kept it towards our BR fees.

Have they taken you to court yet?

Mortgage companies are supposed to assist people in financial distress - there are codes of practice in place these days - no guarantee they will even attempt to assist in reality though!

As mick 1972a has said, change you phone number, we did - it was done in a few days and boy did it make a difference - stopped those irritating people who start at about 8.00 am and stop at about 10.00 pm!! It should not cost you anything.

I told all of my creditors that I was declaring BR and then never answered their calls again. Other people didn't tell their creditors as the creditors can become more aggressive when they know you are declaring BR as they know they won't get their money.

There are advantages/dis-advantages of both options and it doesn't really matter which you do so the choice is really yours.
