Who is classed as the legal owner??

A family member lent my husband and I some money a couple of years back to buy a bigger family car that we so desperately needed. My husband wanted to put his name down as the registered keeper, so we did. Back in May of this year we had paid back half of the borrowed money. We filled out our bankruptcy papers in May and told our family member that we were declaring ourselves bankrupt in June. The family member told us not to add their debt to the forms as didnt want the rest of the money that we owed as things were really tight with us as it was.

This is an interesting question.

did you declare the vehicle on the SOA and if so what did you say about it?

Ownership is absolute or restricted generally. As the car is registered (it seems from what you say) in anothers name then ownership is probably theirs.
I am sure someone wil come up with a more certain answer to what I have said

I read it that the husband's name is down as the registered keeper.

However, the registered keeper is not necessarily the legal owner. My husband is the registered keeper of his mobility car, but it's actually owned by motability.

Hi Richard and thanks for your reply. Yes my husband did declare this on his soa and Im doing by damdest to keep the car that the OR wants to take from us. We have a hearing on 30th September to keep the car and I want as much advice and help before I walk into the court. I cant loose the car, but am scared that we will.

Hi again,

There is a lot of information on the OR technical manual about ownership and proof of ownership of motor vehicles - have a look around Chapter 31 and read what it says.

Also I am sure before the morning someone wil have come up with more definative advice for you.

From what you describe in earlier posts though it all seems a bit unfair if you lose the vehicle

Thanks Richard again for your reply. Im sure that was what CAB read to me when I went to see them a couple of weeks ago. This is a tuff question to answer I know, as really I have paid half back and my family member paid half too. So do we both own it or what??

It will be very unfair if we lose the car and something Im not looking forward to in telling my children should this happen.

Sounds to me as though the other half was a gift to you when your family mamber said they didn't want to go down as your creditors so i can't see the argument that they half own it standing up in court tbh.
