Hi we live in a small town and all bankruptcy's are put in the local paper from using the court in the town. Could I go to a court 40 miles away to do the bankrupt proceedings? as I don't want everyone in the town knowing my business ...thanks

No, it has to be the court in the town where you have lived for the previous 6 months before bankruptcy

ETA: is it really so bad that it may be in the paper? I did not care if anyone saw my notice, I never saw it and I looked regularly, but I felt it a price worth paying to get a new start in life and become debt-free

All bankruptcys are not put in the local paper now, only a few are put in where there are exceptional circumstances

Ok thanks for the info, I heard of a case were a friend of a friend paid somebody to deal with all the bankruptcy process and took it to a court 30 miles from his home so it wouldn't make the local press.

there may have been other reasons as not wanting to be in the local paper is not a good enough one. other reasons could be if they had lived or traded in another area recently, perhaps if they have connections with people in the court.

in exceptional circumstances the judge can order that it not be advertised, for instance if somebody suffered domestic abuse, was a local policeman etc

When I booked my bankruptcy in Liverpool they told me I should be doing the petition in Southport as that is closer than Liverpool, however I asked if I could stick with Liverpool and they were happy with that, so you may be able to. Ring your local court and ask
