Does a creditor need to go to court to obtain an attachment of earnings order on your wages? I am saving up the money to apply for BR but will not have it until Feb/ March 2010, I am really worried that my creditors will get an attacment on my earnings and then I will have no money to save up for BR?

HI

Would you be able to offer each creditor a £1 until the Bankruptcy, send them a letter with income and expenditure and that you are having to save to petition.

At best the creditors may make you bankrupt.

If your debts are below £15k you could look at a DRO

Then as long as you have made reasonable steps, if it is taken to the judge for attachments of earning or CCJ then you ccan argue against it, creditors arent allowed to make a debt situation difficult for a client
