my bankruptcy petiton is to be heard in two weeks time but i have today recieved a letter from one of my crediters to say they are commencing action without further notice to proceed through the courts or to instruct a local collection agent to attend our address, i work and my wife is at breaking point at the thought of bailifs turning up before the petition date, will the creditor go through with the threat before i go to court just to claim anythink they can before im bankrupt if i inform the of the date or do we just sit it out and pray they dont turn up in next two weeks |

Hi,
From my experience it is highly unlikely that a "bailif" will attend. It is not something that you need to be worried about as they would not be able to distrain "on the spot."
It is equally as unlikely that an agent will attend either.
It is a nasty tactic that loan companies adopt, generally to "scare" creditors into paying something.
We all know how stressful these times are and the two weeks will soon be here and it will be included in your SOA and then they can do a majic act and disappear!

The letter says that they are to commence court action. That means that they may ( and I mean may ) start court action so potentially you may receive a county court CLAIM Form within 2 weeks but unlikely.
If they were really on the ball they might be able to get bailiffs within 3 months from now but 2 weaks is impossible.
The letter is designed to worry you with the outcome that you make a telephone call to them in panic and agree to make a payment by debit card.
They possibly may send someone round to the door - a debt collector - they have the same powers as the person on the phone - NONE !!!!!!!
most people in the UK conform to authority and do what they are told. "You owe me money, you must oay now, you must give me a debt card now etc etc".
