Posted - 29 April 2008 : 21:02:38 I am seriously considering bankrupcy as i got into debt due to ill health & losing my job, approx £20,000 My income at present is Incapacity Benefit only & my husband is self employed. My home is shared with my husband and our 5 yr old. My question is would my husbands house which has always been mortgaged in his name only be considered an asset towards repaying my debts. My husband has stated that he cannot afford to help me clear my debts

Posted - 01 May 2008 : 00:24:16 Given the circumstances you describe, I feel it is unlikely that a Trustee could argue that you have developed a beneficial interest in this property.

Posted - 30 April 2008 : 10:49:00 Hi We have been married nearly 3 yrs. The house has been in his name for 17 yrs & all the household bills are also in his name only. He pays all the bills I buy the shopping & kids clothes.
