Posted - 27 September 2008 : 18:29:57 Hello, I hope somebody can put my mind at ease and help me ! I filed for Bankruptcy in Scotland and the AIB recieved the forms on the 5th Sept. On the 9th I recieved the statutory declaration form to declare that I was on benefits/low income, had no assets over £1000 and no property etc. This was returned to them the same day. I have since heard nothing from the AIB but am aware that it can take up to 3 weeks in Scotland for the process to be completed. However, this morning I recieved a letter from Sherrif Officers stating that they would be attending where I live on the 6th Oct to carry out "an attachment". Firstly, I share a flat with friends so my main worry is what will happen to their belongings. Do I phone the Sheriff Officers and explain that I filed for bankruptcy and that the AIB recieved the forms on the 5th Sept ? Do I have to let them into the property ? Do I tell them I have no assets and allow them in the property to my room to check for themselves ? I really don't know what to do and am in a right state as the AIB is closed as is any solicitor as it's the weekend ! Can anyone please give me advice on what to do ? Thank you in advance ! George

Right now i see, i thought for a minute there that the OR was sending someone out. I would def wait and speak to the AIB, they are there to stop all that, this is what we pay them for. Good luck.

Posted - 27 September 2008 : 18:43:44 Thank you for thr quick reply Jo. Basically The Sherif Officer in Scotland is like a bailiff in England if that's any help ? After a "charge for payment" has been issued then in Scotland we can apply for Bankruptcy. which one was and it's the same company that have now instructed the Sheriff Officers/Bailiffs to proceed. Probably best doing as you say waiting till Monday and checking with the AIB. Thanks again ! George

You are in a right state. I am not sure what you should do, but if the Sheriffs officer is not out till the 6th which is over a week away then you have a bit of time to call the AIB on Monday for more advice from them. I take it by Sheriffs office you dont mean the OR as we know it but another debt agency, sorry i am still learning but wanted to try and help a bit. I dont know how BR law works in Scotland maybe one of the other experts will be able to help you. Good luck.
