Hi I am trying to help someone who is retired in Malaysia receiving a very small UK pension and is holder of a UK passport (full British nationality). He has a lot of debts which cannot be paid off on various UK-based credit cards. Can he declare himself bankrupt??

Hi Marianda

to declare BR in the UK He would have to show that UK was the centre of his main interest.

should he pass that test you or a third person could apply for Lasting power of attorney and attend the high court and get him made bankrupt.

alternatly have you looked at arranging a DMP for his finances, you would basically go into negotiation with the credit card companies and offer them a very small amount of money as a regular drip feed, the payments would go on for ever but may be appropriate method of addressing the debts. (payplan are sponsored by halifax but tend to be understanding)

i know that Paul and his team at Reviva, undertake a number of applications for EXpats through out the world to declare BR, it may be appropriate to make contact with him details on the experts to the left

regards Richard
