I am really scared of the interview when I have to meet the judge for the bankruptcy meeting
I guess how best to deal with this? How in depth do they go? I feel such a wally for being here - not helpfil i do realise! |

It will be fine! the Judge goes through it all day and will not Judge you! ( no pun intended) he told us that even judges themselves declate bankruptsy! good luck

In most courts you won't need to see a Judge. Even if you do they will only want to know if you are aware of the restrictions that apply when you are BR and if you are sure this is the best option. They may ask whether you have sought professional advice as well.
Even if you see the Judge you will be in and out with 10 minutes so it's nothing to worry about. |

Hi Janet
The judge is more about making certain that you are making the right decision and that you have taken advice that Bankruptcy is the correct option for you.
The investigation is carried out by a representitve from the official receivers department,
having had to make myself BR the most important time is the time before you submit your petition or even speak to the judge, the pre planning and "getting your ducks in order" is over looked by too many people.
in discussion with my "expert" we delayed my court petition until we were totally ready and the process has been very smooth.

I need to talk to an expert and do appreciate that they are probably very busy
I have emailed over a budget - to one of the experts - how long does it take for them to come back to you? I need to make sure all the figures are in order - did you email each other or meet up with your expert?
I am trying really hard to get "my ducks in order" and want a smooth transition too
Also how long does it take for the investigation - is the where they decide if you can pay towards your bankruptcy ?
Apologoies if I am asking too many questions - and if you are too busy - please do not feel that you have to answer the 20 questions!

Hi janet
Paul @ Reviva got back to me within the day just to acknoweldge the email, we then arranged a telephone chat, mind blowing 30 minutes. It was not just a chat about budget but the whole debt picture and how various options would effect me.
When paul found out that my wife made homemade cakes, that was it, he came and visited shortly after !
we than had a home meeting, the package that was offered felt the right thing for me, with our involvement they took over the planning towards our bankruptcies.
It lifted the burden and some of the stress, as all of the creditor leters went straight to them, it did not stop all of the phone calls but hey ho I had incurred the debt so had to face the music.
The investigation side of things can take upto a year, in all probability if your application is submitted clearly , consisely and as correct as you can make it, the investigation will only last a few months.

I didn't speak to an expert so I don't know how long it'll take for them to reply.
Don't worry too much about what's 'allowed' for expenditure, put down what you need to spend. The OR can only say no or reduce the costs.
I was told at the OR interview that I'd be getting an IPA, but my disposable income was well over £100 so that wasn't a surprise. The OR has up until you are discharged to request an IPA.

Hi Janet,
I wouldn't worry too much about it. I didn't even get to see the judge and my OR chat was over the phone and lasted all of 30 mins. There was no intimidating questions or anything I felt uncomfortable with. I had built myself up into such a state before I went bankrupt and the fear of going to court, seeing a judge, then explaining everything to the OR filled me with terror and I held off declaring bankruptcy for months, just due to the fear of it all. If I had known it would be so painless, I would have done it much sooner.
